These Terms of Service (“Terms“) govern your use of the website, mobile application, and related services operated by 10sConnect, LLC (“10sConnect,” “we,” “our,” or “us“).

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

• You must be at least 13 years old to create or maintain a 10sConnect account.

• Users between the ages of 13 and 17 may use 10sConnect only with the knowledge, permission, and supervision of a parent or legal guardian.

• Parents or guardians who permit a minor to use 10sConnect accept responsibility for supervising the minor’s use of the Services, including communications, payments, and participation in matches.

2. Our Services

10sConnect provides a platform that helps tennis players discover and connect with compatible practice partners.

We facilitate player introductions and communication, but we do not organize, supervise, coach, officiate, or participate in tennis matches.

We do not guarantee:

• That a suitable player will always be available;

• That another player will accept a Match Request;

• That a confirmed match will occur;

• or that another user’s profile information or Player Rating is accurate.

3. Your Account

You agree to:

• • Provide accurate information.

  • Keep your account information reasonably current.

  • Protect your login credentials.

  • Notify us of unauthorized use of your account.

You are responsible for activity occurring under your account.

4. Player Ratings

• A Player Rating is any tennis skill-level information displayed within 10sConnect.

• Player Ratings are provided solely to assist users in identifying potential practice partners.

• Unless expressly identified within the Services as verified by 10sConnect, Player Ratings are not independently verified by 10sConnect.

• Player Ratings should not be interpreted as official rankings, certifications, endorsements, or guarantees of a player’s current ability.
• Information displayed within 10sConnect should not be interpreted as being provided, verified, endorsed, sponsored, or approved by any third-party rating organization, governing body, or tennis association unless expressly stated by 10sConnect.
• Users are responsible for maintaining reasonably accurate Player Rating information.

5. Match Requests

• Submitting a Match Request does not guarantee that another player will accept it.

• Accepting a Match Request does not guarantee that a match will occur.

• Players remain responsible for communicating, arriving on time, honoring commitments whenever reasonably possible, and participating in good faith.

6. Payments

• Certain Services require payment.

• Payments are securely processed by Stripe or another authorized payment processor.

• By submitting payment, you authorize 10sConnect to process the applicable charges associated with your selected Services.

• Applicable taxes and processing fees may apply where required.

7. Cancellations and Refunds

Our current cancellation policy is:

• Matches cancelled more than 24 hours before the scheduled match are generally eligible for a full refund.

• Matches cancelled within 24 hours of the scheduled match are generally eligible for a 50% refund.

Refund eligibility is determined according to the cancellation policy in effect at the time payment is made.

10sConnect reserves the right to investigate suspected abuse of the cancellation process.

8. Safety

Your safety is important.

10sConnect provides a platform that helps players connect for tennis activities.

We do not conduct background checks, verify users’ identities, monitor in-person interactions, or guarantee the conduct, safety, suitability, qualifications, or playing ability of any user.

Users are solely responsible for deciding whether to meet another player.

We encourage users to:

• Meet at public tennis facilities whenever practical.

• Inform someone where they are playing.

• Exercise reasonable judgment.
• Report inappropriate behavior.
• Respect facility rules.

Parents and guardians should supervise matches involving minors whenever appropriate.

Tennis facilities, parks, clubs, schools, and other locations displayed within the Services are provided solely as a convenience. Users are responsible for confirming court availability, reservations, applicable fees, facility rules, and permission to play before arriving.

9. Assumption of Risk

• Participation in tennis and other athletic activities involves inherent risks, including the risk of personal injury, illness, property damage, and other unforeseen events.

• By participating in matches or other activities arranged through 10sConnect, you voluntarily assume the ordinary and inherent risks associated with those activities.

• You are responsible for determining whether you are physically able to participate.
• 10sConnect does not provide medical advice, fitness recommendations, or health evaluations.
• If you have concerns regarding your physical ability to participate, consult an appropriate healthcare professional before engaging in athletic activities.

10. User Conduct

Users agree to:

• Treat others respectfully.

• Communicate honestly.

• Maintain reasonably accurate account information.

• Follow applicable laws.

Users may not:

• Harass, threaten, intimidate, or discriminate against another user.

• Create fake accounts.

• Impersonate another person.

• Attempt fraud.

• Misuse payment systems.

• Upload unlawful or infringing content.

• Interfere with the operation of the Services.

• Use 10sConnect for unauthorized commercial solicitation.

Violation of these Terms may result in suspension or permanent removal from the platform.

11. User Content

You retain ownership of content you create, including:

• Profile photographs

• Journal entries

• Player Cards

• Messages

• Social posts

• Photos

By submitting User Content, you grant 10sConnect a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and process that content solely as necessary to operate and improve the Services.

You represent that you own or have permission to upload any content you submit.

12. Intellectual Property

• The 10sConnect name, logos, software, graphics, text, designs, and related materials are owned by or licensed to 10sConnect and are protected by applicable intellectual property laws.
• You may not reproduce, distribute, modify, reverse engineer, or commercially exploit our Services without prior written permission.

13. Suspension or Termination

10sConnect may suspend or terminate accounts that:

• Violate these Terms
• Threaten the safety of users
• Engage in fraudulent activity
• Misuse the Services or
• Otherwise create unreasonable risk for 10sConnect or its users

Where appropriate, we may investigate reported violations before taking action.

14. Disclaimer of Warranties

• The Services are provided on an “as is” and “as available” basis.
• To the fullest extent permitted by law, 10sConnect disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee uninterrupted availability, error-free operation, successful player matching, or the accuracy of information submitted by users.

15. Limitation of Liability

To the fullest extent permitted by law, 10sConnect, LLC, its owners, officers, employees, contractors, and affiliates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:

• Use of the Services
• Interactions between users
• Missed or cancelled matches
• Player Ratings or other user-submitted information
• Personal injury or property damage occurring before, during, or after a match
• Technical interruptions
• Unauthorized access to user accounts or
• Acts or omissions of third parties

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

16. Indemnification

You agree to defend, indemnify, and hold harmless 10sConnect, LLC and its owners, officers, employees, contractors, and affiliates from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your User Content or
• Your violation of another person’s rights

17. Changes to the Services or These Terms

• We may modify, suspend, or discontinue portions of the Services from time to time.
• We may also revise these Terms periodically.
• Updated Terms will become effective when posted within the Services or on our website.
• Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

18. Events Beyond Our Control

• 10sConnect will not be responsible for delays, interruptions, or failures in the Services resulting from events beyond our reasonable control, including natural disasters, severe weather, power outages, internet or telecommunications failures, cyberattacks, labor disputes, government actions, or failures of third-party service providers.

19. Governing Law

• These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles.
• Any legal action relating to these Terms shall be brought in a court of competent jurisdiction located in the State of Georgia unless otherwise required by applicable law.
